1. Scope of Application

1.1. These General Terms and Conditions (hereinafter "GTC") apply to all contracts concluded between Automation Avenue (hereinafter "Seller") and its customers via the online shop.

1.2. The GTC apply in the version valid at the time of ordering for all orders and deliveries.

1.3. Contradictory or deviating conditions of the customer are not recognized unless the seller has expressly agreed to their validity in writing.

1.4. Consumers within the meaning of these GTC are natural persons with whom business relationships are entered into without a commercial or independent professional activity being attributable to them (§ 13 BGB).

1.5. Entrepreneurs within the meaning of these GTC are natural or legal persons or partnerships with legal capacity with whom business relationships are entered into and who act in the exercise of their commercial or independent professional activity (§ 14 BGB).

2.2. Contract Conclusion

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to order. By clicking the "Buy now" button, you submit a binding order for the goods contained in the shopping cart. Confirmation of receipt of your order occurs immediately after sending the order and does not yet constitute contract acceptance. We are entitled to accept your offer within 3 days of receipt. Acceptance is made by an express declaration of acceptance by email or by shipping the ordered goods.

2.3. Correction Possibilities

Before submitting your order, you can change and view your information at any time. This enables you to recognize and correct any input errors.

3. Contract Language, Contract Text Storage

3.1. Contract Language

The contract language is German.

3.2. Contract Text Storage

The contract text is not stored by us and cannot be retrieved after completion of the ordering process. However, you can print the order data immediately after submitting the order. The order data and the GTC will also be sent to you by email.

4. Delivery Conditions

4.1. Delivery Area

We deliver within Germany and to selected countries of the European Union. Delivery to other countries is only made by individual arrangement and may be associated with additional shipping costs.

4.2. Delivery Times

Delivery times may vary depending on product and availability and will be displayed to you during the ordering process. Unless otherwise agreed or indicated differently on the product, the delivery time is usually 2-5 working days within Germany (4-15 days within the EU) after receipt of the order.

4.3. Shipping Costs

Shipping costs depend on weight, size and destination of delivery and will be displayed to you during the ordering process. From an order value of 100 euros, we deliver free of charge within Germany.

4.4. Partial Deliveries

We reserve the right to make partial deliveries if this is necessary for rapid processing and the partial delivery is reasonable for you.

4.5. Transfer of Risk

The risk of accidental loss and accidental deterioration of the goods passes to you upon handover to you or an authorized recipient.

5. Payment

5.1. Payment Methods

We offer the following payment methods:

  • Payment via PayPal
  • Payment by credit card (Visa, Mastercard, American Express)
  • Payment by direct debit
  • Payment by bank transfer/advance payment

The availability of individual payment methods may vary depending on order value, delivery country or other factors and will be displayed to you during the ordering process.

5.2. Payment Conditions

Payment of the purchase price is due immediately upon conclusion of the contract. For payment by bank transfer/advance payment, the invoice amount must be transferred to the specified account within 10 days of receiving the order confirmation.

5.3. Retention of Title

The delivered goods remain our property until full payment.

5.4. Default

If you default on a payment, we are entitled to demand default interest of 5% above the respective base interest rate p.a. The assertion of further damage claims remains reserved.

6. Right of Withdrawal

6.1 Right of Withdrawal for Consumers

Consumers are generally entitled to a right of withdrawal. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor independent professional activity.

6.2 Withdrawal Instructions

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took or has taken possession of the last goods.

To exercise your right of withdrawal, you must inform us by means of a clear statement (e.g. a letter sent by post or an email) of your decision to withdraw from this contract. You may use the attached model withdrawal form for this purpose, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

6.3 Effects of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in no event will you be charged fees for such reimbursement.

8. Transport Damage

8.1. If goods are delivered with obvious transport damage, please complain about such defects immediately to the delivery person and contact us without delay. Failure to complain or contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, you help us to assert our own claims against the carrier or transport insurance.

9. Warranty and Guarantees

9.1. The warranty is governed by statutory provisions.

9.2. A guarantee exists for goods delivered by the seller only if it has been expressly given. Customers are informed about the guarantee conditions before purchase.

Restrictions for Entrepreneurs

For entrepreneurs, only our own specifications and the manufacturer's product descriptions that have been incorporated into the contract apply as agreements on the quality of the goods; we accept no liability for public statements by the manufacturer or other advertising statements. For entrepreneurs, the limitation period for defect claims for newly manufactured goods is one year from the transfer of risk. The sale of used goods is made excluding any warranty. The statutory limitation periods for the recourse claim according to § 445a BGB remain unaffected.

Regulations for Merchants

Among merchants, the duty to examine and give notice of defects regulated in § 377 HGB applies. If you fail to give the notice regulated there, the goods are deemed approved, unless it is a defect that was not recognizable during the examination. This does not apply if we have fraudulently concealed a defect.

10. Liability

We are only liable for damages if they are due to grossly negligent or intentional behavior. For slight negligence, we are only liable in case of violation of essential contractual obligations (cardinal obligations) or for damages resulting from injury to life, body or health. In this case, however, liability is limited to foreseeable, contract-typical damage. Liability under the Product Liability Act remains unaffected.

11. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), which you can find hier We are not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration body.

12. Final Provisions

If you are an entrepreneur, German law applies excluding the UN Convention on Contracts for the International Sale of Goods.
